Eligibility

To succeed, you must meet all ESDC (Employment and Social Development Canada) requirements, including a four-week recruitment effort, competitive wages, and avoiding any negative labour dispute impact. Your employer might be new to the LMIA process, so don't rely solely on their knowledge. We recommend starting the LMIA process well in advance.

Important facts about LMIA:

• Employers must pay $1000 fee for each LMIA requested.
• Wages offered to worker should be similar to wages paid to Canadian and permanent resident employees hired for the same job and work location and with similar skills and years of experience.
• Jobs are divided into two categories – high-wage, where salary meets or exceeds the median wage in the province, and low-wage, where salary is below the median wage in the province.
• The duration of work permits based on positive LMIA is limited to a maximum of two years for all low-wage positions and a maximum of three years for high-wage positions.
• Selected occupations are eligible for 10-day processing times.
• Candidates with a valid job offer in an NOC TEER 0 are awarded an additional 200 points, and candidates with a valid job offer in an NOC TEER 1, 2 or 3 occupations are awarded an additional 50 points.
