Work Permit

Work permits frequently serve as pivotal stepping stones toward securing permanent residency status in the country.

Overview

A work permit is an official document that allows individuals to legally work in Canada for a specified duration. It is usually job-specific, tied to an employer, and may have location restrictions. Obtaining a work permit involves meeting specific eligibility criteria and requirements. While work permits are temporary, they can be a crucial step toward permanent residency through various immigration pathways, such as Express Entry or Provincial Nominee Programs.

Eligibility

The Canadian government offers three main types of work permits to accommodate various circumstances and qualifications.

Working Holiday Work Permits: These permits are typically issued to young adults from countries that have a bilateral agreement with Canada. They allow individuals to work in Canada while exploring the country.

Spousal Work Permits: Spouses or common-law partners of certain temporary residents, such as students or workers, are eligible for this type of permit, which allows them to work in Canada.

Post-Graduate Work Permits: Recent international graduates who have completed a program at an eligible Canadian institution can obtain post-graduate work permits, allowing them to gain valuable Canadian work experience.

Bridging Open Work Permits: These permits are designed for temporary residents who have applied for permanent residence and are waiting for a decision. They help bridge the gap and allow individuals to continue working in Canada.

Young Professionals Work Permits: Individuals who have a job offer in Canada and meet the specific criteria for this category can obtain a work permit. It is part of international agreements that promote youth employment.

PNP Nomination-Based Work Permits: Provincial Nominee Programs (PNP) allow Canadian provinces and territories to nominate individuals for immigration. Those nominated may receive a work permit that is tied to that province's nomination.

Francophone Mobility Work Permits: These permits support the movement of French-speaking workers to Canada in an effort to enhance the linguistic diversity of the country.

CUSMA, CETA Work Permits and Other Free Trade Agreements Work Permits: These are for individuals who qualify under international trade agreements or other free trade agreements to which Canada is a party.

To obtain this type of work permit, an employer in Canada must first obtain a positive Labor Market Impact Assessment (LMIA) from Employment and Social Development Canada (ESDC). The LMIA assesses the need for foreign workers and ensures that hiring them won't negatively impact the Canadian labour market. Once the LMIA is approved, the foreign worker can apply for a work permit specific to the job offered.
